Prenuptial & Postnuptial Agreements
In New York, couples may enter into contracts — before marriage with a prenuptial agreement, or after marriage with a postnuptial agreement — to contemplate and address the disposition of property upon divorce or death. We have extensive experience negotiating and crafting thorough and clear agreements that protect a client’s rights, while minimizing any potential stress during the process.
Prenuptial agreements have become more common, but as in any other area of our practice, there is no “one size fits all.” Each client who comes to us has a different narrative, but often the goal is the same – to protect current and/or future assets. We are knowledgeable, adept, and efficient in drafting prenuptial agreements for clients entering into a marriage with substantial assets, or an expectation that the client’s financial position, through their employment, investments, or a future inheritance, will one day materially change the client’s personal net worth.
Postnuptial agreements are often desired when a client did not have sufficient time to enter into a prenuptial agreement, a financial change in circumstances has occurred, a change in the relationship has occurred, or in connection with estate planning.
